Who Phoenix Photography is

Phoenix Photography is operated by Ruan de Witt, trading as Phoenix Photography, an independent photography business based in Johannesburg, Gauteng, South Africa.

Using this website

You may use this website for ordinary personal and informational purposes, including learning about Phoenix Photography, viewing portfolio work and contacting me about photography services.

You may not deliberately use the website in a way that is unlawful, harmful or interferes with the site or another person's use of it.

In particular, you may not:

• attempt to gain unauthorised access to the website, server, private galleries or download systems;
• introduce malicious code or intentionally disrupt the site's operation;
• misrepresent yourself when submitting an enquiry or request;
• systematically scrape, harvest or extract site content or personal information without permission; or
• use the website or its content for an unlawful purpose.

An enquiry is not a booking

Sending a form, email, WhatsApp message or social-media message is simply the start of a conversation. It does not create a booking, reserve a date, guarantee availability or oblige either of us to proceed.

A photography booking is only secured in accordance with the separate quotation, booking form and/or photography agreement provided for that service, including any booking fee and other booking requirements stated there.

If a separate photography agreement is concluded, that agreement governs the photography service itself — including matters such as scope, payment, cancellation or rescheduling, image delivery, usage rights and any service-specific conditions.

Pricing, availability and website information

I try to keep the information on this website accurate and current. Photography packages, starting prices, inclusions, availability, travel requirements and other service information can nevertheless change over time.

Unless a specific written quotation or agreement says otherwise, information shown on the website is general information rather than a binding offer. The final scope and price for a booking are the ones confirmed in the quotation or agreement accepted for that booking.

If the website contains an obvious error, outdated detail or technical mistake, please contact me and I will correct it as soon as reasonably possible.

Photographs, writing and copyright

Unless stated otherwise, the original photographs, text, branding, design elements and other original material published on this website are owned by Phoenix Photography / Ruan de Witt or are used with permission. Photographs are protected as artistic works under South African copyright law.

You may view the site and share ordinary links to its public pages. You may not, without prior written permission, reproduce, download for republication, sell, license, alter, remove watermarks from, commercially exploit or republish substantial site content or photographs.

You may also not use photographs or other original Phoenix Photography content to build datasets or train, fine-tune or evaluate machine-learning or generative-AI systems without prior written permission.

Client rights to delivered photographs are governed by the relevant photography agreement. These website terms do not reduce any usage rights expressly granted to a client in that agreement.

Links and third-party services

The website may link to services operated by other organisations, including WhatsApp, Instagram, Facebook, Google or other platforms. A link is provided for convenience and does not make Phoenix Photography responsible for that service's content, availability, security or privacy practices.

When you leave this website and use a third-party service, that service's own terms and privacy rules apply.

The website may also display information supplied by Google Maps Platform, including Phoenix Photography's current Google Maps rating and review count. Google Maps content is subject to Google's applicable terms and privacy practices.

Privacy, POPIA and cookies

Personal information submitted through this website is handled in accordance with the Privacy & POPIA Notice. The site's use of browser storage and optional analytics is explained in the Cookie Notice.

Google Analytics is optional on this website and does not load unless the visitor allows analytics through the site's cookie controls.

Website availability

I make reasonable efforts to keep the website working and secure, but I cannot promise uninterrupted or error-free access. The site may occasionally be unavailable because of hosting problems, maintenance, security work, internet failures or circumstances outside my control.

Website features, pages and content may be changed, removed or updated when reasonably necessary.

Responsibility and liability

The public website is provided primarily to show my work, explain Phoenix Photography and allow people to make contact. You remain responsible for decisions you make based on general website information until specific details are confirmed with me in writing.

To the extent permitted by South African law, Phoenix Photography is not responsible for indirect or consequential loss caused solely by ordinary use of, or temporary inability to use, the public website or an external site linked from it.

Nothing in these terms excludes, restricts or attempts to waive a right or remedy that may not lawfully be excluded under the Consumer Protection Act, the Electronic Communications and Transactions Act or any other applicable South African law.

Nothing here excludes liability where the law does not allow that liability to be excluded or limited.

South African law applies

These website terms are governed by the laws of the Republic of South Africa. If part of these terms is found to be invalid or unenforceable, the remaining parts continue to apply to the extent permitted by law.

I may update these terms when the website, business or applicable legal requirements change. The date at the top of this page shows the latest published version.
